Please read these terms carefully before using our diagnostic services.

1. Introduction & Acceptance

Welcome to Nestlabs Diagnostics. These Terms of Service ("Terms") govern your use of our diagnostic services, website, and facilities located at 101 Panchvati, Beside Hitawada Press, Wardha Road, Dhantoli, Nagpur 440012, Maharashtra, India.

By accessing our services, booking appointments, or undergoing diagnostic tests, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using our services.

These Terms are governed by the laws of India, including but not limited to:

  • Clinical Establishments (Registration and Regulation) Act, 2010
  • Indian Medical Council Act, 1956
  • Consumer Protection Act, 2019
  • Information Technology Act, 2000
  • Indian Contract Act, 1872
2. Our Services

Nestlabs Diagnostics provides the following medical diagnostic services:

  • MRI Scans: Magnetic Resonance Imaging services
  • CT Scans: Computed Tomography imaging
  • X-Ray Services: Digital radiography
  • USG/Ultrasound: Sonography and Doppler studies
  • Pathology: Laboratory tests and blood work
  • Health Check-ups: Comprehensive screening packages

Operating Hours: 9:00 AM to 10:00 PM, all days including holidays.

Services are subject to availability, equipment functionality, and qualified staff presence. We reserve the right to modify, suspend, or discontinue any service without prior notice.

3. Appointments & Booking

3.1 Booking Process

  • Appointments can be booked online, via phone, or in person
  • A valid prescription/referral may be required for certain tests
  • Accurate personal and medical information must be provided
  • Confirmation will be sent via SMS/Email

3.2 Cancellation & Rescheduling

  • Appointments may be cancelled or rescheduled at least 4 hours before the scheduled time
  • Repeated no-shows may result in booking restrictions
  • Refunds for prepaid appointments will be processed as per our refund policy

3.3 Patient Responsibilities

  • Arrive 15-30 minutes before your scheduled appointment
  • Bring valid ID proof and prescription (if applicable)
  • Follow preparation instructions (fasting, medication, etc.)
  • Inform us of any medical conditions, allergies, or implants
  • Inform us if you are pregnant or suspect pregnancy
4. Payment Terms

4.1 Pricing

  • All prices are in Indian Rupees (INR) and include applicable taxes
  • Prices are subject to change without prior notice
  • Price at the time of booking will be honored
  • Additional charges may apply for contrast agents, oxygen, or special procedures

4.2 Payment Methods

  • Cash, Credit/Debit Cards, UPI, Net Banking
  • Corporate billing (with prior arrangement)
  • Insurance (TPA) - as per tie-up terms

4.3 Refund Policy

  • Full refund if test cancelled due to our inability to provide service
  • Refund minus processing charges if cancelled 24+ hours before appointment
  • No refund for no-shows or cancellations within 4 hours of appointment
  • Refunds processed within 7-10 business days

4.4 Insurance

We work with various insurance companies and TPAs. Coverage depends on your policy terms. Patients are responsible for any amounts not covered by insurance.

5. Medical Disclaimer

Important:

  • Our services are diagnostic in nature and do not constitute medical treatment
  • Test reports are interpretations based on the information provided and images/samples obtained
  • Reports should be reviewed by qualified medical practitioners for diagnosis and treatment
  • We are not responsible for treatment decisions made based on our reports
  • In case of critical/abnormal findings, we will attempt to contact the patient/referring physician immediately

Our reports are tools to assist healthcare providers and should not be used for self-diagnosis or self-treatment.

6. Patient Rights & Consent

6.1 Informed Consent

  • Written consent will be obtained before invasive procedures
  • Patients will be informed about the nature of tests, potential risks, and alternatives
  • For contrast studies, specific consent regarding contrast agent administration will be taken
  • For minors, consent from parent/legal guardian is mandatory

6.2 Patient Rights

  • Right to be treated with dignity and respect
  • Right to privacy and confidentiality
  • Right to receive information about your diagnosis and treatment
  • Right to access your medical records
  • Right to seek second opinion
  • Right to refuse treatment (with understanding of consequences)
  • Right to complain without fear of discrimination
7. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Nestlabs Diagnostics shall not be liable for any indirect, incidental, special, or consequential damages
  • Our liability for any claim shall not exceed the amount paid for the specific service
  • We are not liable for delays or failures due to force majeure events
  • We are not responsible for treatment outcomes based on our diagnostic reports

Nothing in these Terms excludes liability for death or personal injury caused by our negligence or fraud.

8. Intellectual Property
  • All content on our website, including logos, text, images, and software, is our property
  • Diagnostic reports are provided for personal medical use only
  • Unauthorized reproduction, distribution, or commercial use is prohibited
  • Patient medical records belong to the patient; we maintain custody as required by law
9. Dispute Resolution & Governing Law

9.1 Grievance Redressal

Any complaints or grievances should first be addressed to our Grievance Officer. We aim to resolve complaints within 30 days.

9.2 Mediation

If the grievance is not resolved satisfactorily, parties agree to attempt mediation before legal proceedings.

9.3 Jurisdiction

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Nagpur, Maharashtra.

9.4 Consumer Forum

Nothing in these Terms affects your statutory rights under the Consumer Protection Act, 2019. You may approach the appropriate Consumer Forum for redressal.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on our website. Continued use of our services after modifications constitutes acceptance of the updated Terms.
